We are committed to protecting your personal information and your right to privacy.

This WorkStreams Privacy Policy (“Privacy Policy”) extends the WorkStreams TOS as an additional terms policy and applies to all of the services. Terms defined in the TOS apply throughout the Privacy Policy.

Information We Collect

Personal information is data that can be used to identify or contact a single person.

As a visitor, you can browse our websites to find out more about our services. You are not required to provide us with any personal information as a visitor.

Information You Provide to Us

We collect your personal information when you register with us by submitting a form, creating an account, submitting an order, installing our software on your computer, or otherwise contacting us. Generally, you control the amount and type of information you provide to us when using our services. Log Information

We automatically receive information from your web browser, mobile device, or computer depending on your use of our services. Examples of the information we collect and analyze include:

·          When you access our websites:

o    We receive certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses, type of mobile device, and computer operating system. We also use website analytics tools on our sites to retrieve information from your browser, including but not limited to the site you came from, the search engine(s) and the keywords you used to find our site, the pages you view within our site, your browser add-ons, and your browser's width and height.

o    The links clicked and other actions taken on our websites are tracked through the use of technologies such as cookies and web beacons to collect information about the pages viewed.

o    We also deliver advertisements through various means including third party sites and services. We utilize analytics tools to collect information about page views and access to and use of these advertisements as well.

·          When you opt in to receive our email newsletters and/or transactional communications:

o    When you receive email from us, we may use web beacons, customized links or similar technologies to determine whether the email has been opened and which links are clicked, in order to provide you more focused email communications or other information.

·          When you install our software:

o    Events are generated and submitted to us that contain data about errors, warnings, and audited situations that occur during use of the services. Event information can include details about the user account, mailbox, computer, related software versions present on the machine where the event was generated, data from your computer’s event logs, as well as details about what the services code was doing when the event was generated. Events related to errors and warnings that occur through the use of our software may include identifying information about the files or mailbox item(s) related to the issue, but in no case will never contain the private content of a document or message body. This information enables us to address issues that arise due to the variations in computer configurations and use of the services, as well as to continuously optimize and improve the services.

In order to offer you a more consistent and personalized experience in your interactions with us, the information collected through the various described means may be combined with information obtained through other services and may also be supplemented with information we obtain from other companies (in all cases “information”). For example, we may use the capabilities available from other companies that enable us to derive a general geographic area based on your IP address in order to customize certain services to your geographic area.

Our Use of Information

We use the information we collect to operate and improve the services. These uses include adding to and improving the capabilities of the services; resolving issues and situations that arise with the functionality of the services; providing you with more effective customer service; making the services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving the services; and displaying content and advertising that are customized to your interests and preferences.

We also use your personal information to communicate with you.

·          We may send certain mandatory service communications such as welcome letters, billing reminders, information on technical service issues, and security announcements. Because this information is important to your interaction with us, you may not opt out of receiving these communications.

·          Some services send you informative periodic emails as part of the functionality of the service.

·          We may also occasionally send you product surveys or promotional mailings to inform you of other products or services available from us or our affiliates, and/or share your personal information with our partners so they may send you information about their products and services. You can opt-out from receiving newsletters or promotional e-mail anytime by clicking the unsubscribe or preferences link in the respective newsletter or promotional email.

Except as described in the WorkStreams Privacy Policy, we will not disclose your personal information outside of us and our affiliates, partners, subsidiaries, and distributors without your consent. Some of our sites may allow you to choose to share your personal information with select partners so that they can contact you about their products, services or offers. You may also be presented with a separate choice as to whether you wish to receive communications about a partner's particular offering.

Some services are co-branded by WorkStreams and another company that we partner with. If you register for or use such a service, both the WorkStreams Privacy Policy and the partner’s privacy statement may be displayed. If so, both WorkStreams and the partner will receive information you provide.

We may occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, hosting websites, processing transactions, or performing statistical analysis of the services. The companies providing these services will be permitted to obtain only the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose than for delivering the service to WorkStreams in accordance with our terms and policies. These providers may use aggregate data for fraud detection to help improve their services. This helps them to more accurately detect fraudulent transactions.

We may access or disclose information about you, including the content of your communications, in order to: (a) comply with the law or respond to lawful requests or legal process; (b) protect the rights or property of WorkStreams or our customers, including the enforcement of our agreements or policies governing your use of the services; or (c) act on a good faith belief that such access or disclosure is necessary to protect the personal safety of our employees, customers, or the public. In the event of a merger or sale of assets or similar corporate transaction we may also disclose information.

Data Security

The security of your personal information is important to us and we are committed to the protection of it. We design our systems with your security and privacy in mind.

·          We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.

·          We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.

·          We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.

·          It is your responsibility to keep your password confidential to help protect your accounts and personal information. Do not share this information with anyone. If you are sharing a computer with anyone you should always log out and clear the history cache before leaving a site or service to protect access to your information from subsequent users.

Links to Other Sites

We are not responsible for the practices employed by websites linked to or from WorkStreams, nor the information or content contained therein. When you use a link to go from any WorkStreams website or service to another website, this Privacy Policy is no longer in effect. The browsing and interaction you conduct on any other website, including those that have a link from WorkStreams, is subject to that organization’s terms and policies. Please review those terms and policies before proceeding.

Information Collection and Use Regarding Children

Some services are intended and available for general audiences and do not knowingly collect any personal information from children. When a service does collect age information, and users identify themselves as under 13, the site will either block such users from providing personal information, or will seek to obtain consent from parents for the collection, use and sharing of their children's personal information. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to WorkStreams. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. We will not knowingly ask children under the age of 13 to provide more information than is reasonably necessary to provide our services.

It is a good idea to talk with your children about communicating with strangers and disclosing personal information online.

Your Privacy Rights

You can help ensure that your contact information and preferences are accurate, complete, and up to date by signing in to your account WorkStreams Account. For other personal information we hold, we will provide you with access (including a copy) for any purpose including to request that we correct the data if it is inaccurate or delete the data if we are not required to retain it by law or for legitimate business purposes.

We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes as described earlier.

California

The California Consumer Privacy Act provides California consumers with the right to obtain from us information about the personal information about you that we collect, use, and disclose. You can exercise your rights by contacting our Data Protection Officer as described below.

If you choose to exercise your privacy rights, you have the right to not to receive discriminatory treatment or a lesser degree of service from us.

Nevada

You have the right to opt-out of the sale of your personal information. We do not sell your personal information.

For the purpose of this Privacy Policy, we are a Data Controller of your personal information.
